Gurus,
My wife got a job offer on contract basis for 3 months. I am on h1 and she is on h4 so far. I am planning to stay on h1 itself. If my wife accepts this job using EAD, Does my status also changes? Is it okay if she dont find a job after this contract expires, what status she will be in during that time, h4 or EAD?
Please advice, Thanks a lot ....

I received I485 receipts from my lawyer, they are missing my priority date which is in sept 2002. Not sure why they are missing..

An H-1 petition filed by a new employer should have no direct impact on your AC-21 GC process. Because you are not currently in a valid non-immigrant status, you are not eligible for a change of status in the US. In any event, the petition would not be valid before 10/1/2010 assuming the employer is not cap exempt. So, you would have to travel out of the US to apply for the H-1 visa to be stamped in your passport. To be safe, you should make sure you have a valid AP with you before travelling just in case there is a problem ofr delay at the consul.

1st time prevailing wage was OK (lower than the salary). This time during extension, prevailing wage is more that the salary, though salary increases over the time. So employer is telling they r not able to renew H1B, because it is hard to increase the salary due to the inequity among employers. What is the solution? Thanks

I am very new to this world of immigration employment, and I am not sure what I need to do to assist an associate in finding employment and (ultimately residency) in the US. He is a friend of mine's father, and has been out of work in the Ukraine for the last 8 months; he is an electrical engineer by trade and has university degrees.
From what I can gather, the Employ American Workers Act seems like it could be an impediment in obtaining a H-1B Visa (This is the type of Visa that he would need to work in the US, correct?)
Can anyone provide any guidance or suggestions on how to begin the job seeking process, and potential obstacles to be aware of?

I just got my approval (Mar 06, TSC), finally! The key issue that I am facing is that I am not in US at the moment and it is very difficult for me to return immediately.
1. Is it okay that I come back after a month or so?
2. Secondly, my AP is expiring later this month though I have H1B stamped till next year. The issue is that earlier this year I had used AP to enter US in spite of the fact that I had a valid H1B. DOES this invalidate my H1B visa? Can I use the H1B visa to enter US after my AP expires???
Is there anything else I can do such as getting the cards fedexed to me and use them to enter US?

As per the new regulation, you can apply for VISA in any consulate in INDIA. This removes the ambiguity of choosing/justify the choice of a different consulate other than the one in your consular district. Refer to the link below. Hope this helps!!!

Yes, this is very common. BTW once IO at POE made an error and give I-94 till 3 years when my I-797 was expiring in less than a year. Immediately came back to him and brought to his attention and he corrected it.

May be it is worth it or may be not....In www.cnn.com there is a section (on the left hand side) asking what the democrats should do first. (They are basically asking our opinion)
I wrote down some items that I thought they should discuss, namely, in the area of legal immigration relief for EB categories.

hello all,
I wanted a clarification regarding address change:
My company changed address recently from address City A to address City B (same county, same metropolitan area). Do you know if I need to do any LCA Amendment?
I had consulted a lawyer regarding this, he said we don't need to do any LCA Amendment since it is the same metropolitan area.
Also I am not getting any clear answers from any other websites.
Wanted to cross check with you all. If anybody know please help.

USCIS has been "pre-adjudicating" I-485's without current priority dates so that they can be approved expeditiously once priority dates become current. This is likely a waste of effort given that it may be years before many EB-3 priority dates are reached.

Hi Buddy,
Put your address in 485 apps. You may at some point want to change the employer under AC21 rule and this will allow you to 'carry' the 485 process with you. Basically you own 485 process whereas it's not the case with labor and I-140.
