My fiance came to the US from Mexico on a short term Visitors Visa more than 14 years ago and did not return to Mexico when it expired. No extensions were ever applied for. She has been working and paying taxes since shortly after coming to the US. I am a US born citizen, and have an income capable of sponsering her. Her own employment record is quite good as well. I understand that there would likely be an interview process which we should easily pass since we have had a lengthy multi-year relationship.
1) What are the steps for legalizing her status after we are married?
2) Will she be required to stop working while her application is considered?
3) Would she be required to leave the country during processing?
3) What is the average time required to go through the process?
4) What are the restrictions on her traveling outside the US during/after the process of legalizing her status?
I will be seekign an immigration lawyer to nail this down and start the process, but need a framework of the process and considerations, so we can get through this as easily as possible.

question about i-20. do u need to submit only 1 i-20 that you received when entered the school or u need to submit the travel i-20 u get whenever u travel outside usa while on f1 visa?

Post MBA (since Jun'06), I am working with a new employer. My previous employer (bachelor degree), filed for my labor in Nov'04 and I left this company in Jun'06; howevr employer didn't withdrew my labor application. My labor with previous employer was approved in Feb'07. I have good relation with my previous employer and they are ready to file my I-140; I have few questions regarding this:
Can my previous employer file I-140, even if I am not working with them?
If I-140 is approved, would I able to transfer the PD to my new employer, when he initiates my labor application.
Once I transfer my PD, can my previous employer use this approved LC for other candidate?
Based on my new qualifications (MBA), my job description has changed totally compared to my previous job.

I called USCIS regardng my I-140 approval notice and I was told that "It normally takes upto 30 days to receive any approval/receipt notices". Hope it helps!

A# gets assigned at the I-140 stage. The I-140 should have the A#.
Not sure about requesting without A# , may be it can be done.

Are people getting soft lud on 485 recently?.
The reason why i am asking this is my 485 did not have any LUD for past 1 year and i got one today for all my 485(mine,dependents). 140 did not have any LUD only 485s. No AP,EAD renewals..
I know from previous threads it means nothing. Just wanted to check. Was trying to not post about this but at last i posted.
My wife got RFE after this LUD, Mine and my kid's no change. Waiting for RFE details. I think since the processing time for Texas is Aug 2007 they are pre adjusting the apps, i guess.

Please call USCIS or better yet, take an infopass appointment.
I can not take infopass appointment as I don't have receipt number. Alos, I called up USCIS and they informed me that it is taking longer time for entry and so far they don't see my EAD and AP entries in their system. Although they have received I-485 which was sent along EAD/AP. I just wondering if anyone come across similar sitaution, also does it make sense to file EAD/AP again without any further waiting ?

You will have to staple the old passport to the newer one and carry both of them at all times. The visas on the previous passport will not be transferred over to the new passport.

Does I-140 have to be approved before using AC21? In my case, I140 has been pending for 1 year now, but got EAD recently.
If I use AC21 to move to a new job in 6 months, can employer pull out the I-140 ?

So guys just off the phone with a very decent IO at NSC . talked to her 30 mins, yes you are right 30 mins..which is unheard off..
the questions that I asked were very simple

Q3: Okay, but can u tell me if my namecheck has been cleared (although i checked a week back and another IO told me it was cleared)
A3: No, for privacy purposes we cannot disclose this info
Q4: Okay then can you tell me why there was a LUD on my approved I40 on 7/13. (guess there were lots of us who had this)
A4: Yes, I can tell you that, what is your Receipt number
Q5. Here is my recpt number
A5: Okay it looks like your I140 was filed at Texas and they sent the file over to us. we consolidated that with your I485
Q6: Does that mean that my case is being worked upon
A6: No it does not mean that. This step is one of many many steps that are required for 485 processing. so this will not tell you anything
Q7: Is my case assigned to a IO
A7: No we cannot give this info, and even if you have this info, it is useless info as the center is going towards Backlog.
Q8: Then what is the meaning of processing dates as issued by USCIS
A8: They dont mean much,. they are just a gestimation of where things stand, and as off now the centers are facing backlog. there is lot of restructuring going on within the centers. The place to check is on the website., any change will be reflected there and it is upto date.
This was the gist of my call with the IO today.. w
What is the bottom line?
Sit tight and things will move only when USCIS wants.. nothing will happen otherwise..

Thanks for the reply. My priority date is May 1 2006 so I am not concerned about me gettting approved. I dont remember the 140 mailing date so the data is not accurate

I think you should send a copy of the 485 Receipt notice.. This is a classic, Right hand not knowing what the left hand does situation with USCIS..
I received an RFE for my EAD renewal.
It says "Please submit proof that you have filed an I-485 Application"
I have a copy of my receipt of I-485. Would that be enough to send? Why would they ask for proof of I-485? This is my second EAD renewal.
Please let me know.

Depends on whether the role for which he is applying requires a PhD or not. Once again, consult a good lawyer.
Small addition to your post. EB1A does not require a job offer, but it needs the applicant to prove exceptional ability. EB1B (outstanding researcher or professor) and EB1C (multinational manager) do need sponsorship and a job offer.

My lawyer sent out the LC Substitution/140/485/EAD on July 2nd and said that all these can be filed concurrently and he wanted to take advantage of the dates being current.
I read in several forums that it's necessary to have the LC substitution stage completed before filing for 140/485. Is this true?
Is it possible that there are more chances of LC substitution denial? If so, what are my options?

I am a newbie as well and have filed I-485, I-131, and I-765, and they reached USCIS by July 2nd. What happens now?:confused: I mean, I understand we will get I-485 receipt and AP and EAD and might even be called for finger printing. What after that?

After the show down of the USCIS and all the high skilled immigrats. USCIS posted that they are withdrawing the July 2nd board. This is great news.
I have filed my I-485, I-131, and I-765, and they reached USCIS by July 13th. According to the new board, USCIS will no long reject them.
So what will happen from now on? What is the procedure after this?
I guess this might be a newbie question. If someone can post some answers for me, it will be very helpful.
