    Guys,
I am currently working as Programmer Analyst for a company who is currently doing the GC. I have been with them for about 7 years.

Starting next month I am going to use my H1 7th year.

I am pondering about a new offer Firmware Engg. My GC detaisl are below:
    PD: 06/2003 -- EB3
    Education: MS

I am planning to stay in H1B, if possible with the new employer. But thinking of doing PERM and see if I can port my earlier date during I-140 filing.

    Any suggestions or recommendations ...

    Thanks

    Srini

Unless you know the outcome, you never know.

Just be candid and talk to your employer. Sometimes they don't even know this as diff ppl in HR handle and interpret cases differently. I would talk to my employer.

this makes it very hard for people who jumped jobs in their 7th/8th years with 1 year extensions from new employer. All were hoping to get LC+I_140 done within that year so they are eligible for further H1B extensions.

Iam on L2 and working on my EAD which is expiring on april 29 th 2011.

I have applied for H1 in the 2010 quota but due to my employers mistake i got a rejection on that.
we are trying to reappeal to USCIS but iam not sure if its going to work.

Suppose i have a project and apply again for 2011 quota , can i still continue working even if my EAD expires.
They say that we actually move to H1 on October , so if i apply before end of April through premium processing and get an approval notice before October can i continue working or start work right away or do i have to wait till October.
Is there a possibility to start working immediately as soon as my H1 gets approved or do we have to wait until October in any case.

    Thanks in advance

starting with : we have 'uh' did what right for arizona...

No wonder why AZ tightened the immigration law, may be illegal immigration caused the damage on American grammar.

..."we have DID what was right for Arizona..."...

Madame Governor needs lessons in basic english grammar...Wren and Martin is in order.

My I-485 was filed in month of August 2008 under EB2 .I was laid off from my I-485 sponsoring employer(A) in month of August 09 and i took another Job with employer (B) in same field in month of Sep 09. I did not file AC21 as my previous employer's(A) attorney advised not necessary to file AC21.Now I am getting new offer from another employer(C) in same position but this new employer(C) wants me to file AC21 .

What are my options now? Should i file AC21 for employer (B) first and then file AC21 for employer (C) or should i directly file AC21 for employer (C).

I will greatly appreciate your reply.

    Hi,

I lost my jon w/big software consultancy. I found another project and then applied for H1-B transfer with Indian consulting company. Its been almost 1 month since new company have filed for H1-B transfer and renewal (my H1-B was expring on July 6th, 2009).

so far, i've not received any H1-B recipt. I'm worried about it. I'm also getting married in the last w/e of Nov, 2009. Is it a good idea to file for Premimum processing.

    Thanks,

    Rajeev

    Readers,

    My I-797 expires on Dec 20th 2008
My 6 year term of H1b is between 2004 Oct till 2010 Sep
My previously filed PERM & I-140 are under the verge of rejection due to a pending RFE.

I am planning to file another PERM. Even though I'm trying to do it ASAP, I'm wondering whether I have an advantage on filing new PERM before Dec 20th 2007.

While applying for H1B extension in Dec 2008, If I have an approved labor/pending I-140 I thought I could request for 3 year extension. If I don't have labor/I-140 pending I can only request for 20 months extension (as my 6 year H1B term ends on Sep 2010)

I read from a site that...

"One in H1B/H-4 status can extend to the end of the 6-year limit, and then take advantage of the provisions allowing extensions beyond the 6-year limitation, if the labor certification or I-140 was filed at least a year earlier."

When I asked this question to my attorney he said

You can file for an H-l B visa extension up to 6 years. You can only file for an extension past the 6th year if your labor certification and/or I-l40 was pending for more the 365 days prior to the 6th year on your H-lB Visa status. If not and your labor certification is approved and the I-l40 is pending then you can only request an extension in one (l) year increments only until a final decision is made.

So does this mean I can only request for a 12 month extension if labor/I-140 is pending on Nov 2008?

Readers, Please provide me your guidance....
    Thanks in advance

My 140 (filed concurrently with 485) was approved on Aug 17th. Ever since 08/17 I have been seeing LUD's on it everyday. In fact there was a LUP on 08/19 Sunday! Any ideas what's happening? I think something is going in CIS.

In the March issue of BioScience (a widely read scientific journal) Gillean Andres reports on the growing momentum for new federal incentives to attract new students into careers in science, technology, engineering, and mathematics. The article is available here: Washington Watch: The Cost of Doing Business: Should the United States Create Incentives for science, technology, engineering, and mathematics (STEM) Labor? (http://www.aibs.org/washington-watch/washington_watch_2006_03.html).

Legislators in both parties have been attentive to these proposals. High-profile Republicans, including Representative Frank Wolf (VA) and former Speaker of the House Newt Gingrich, were among the first advocates for a renewed investment in innovation to protect the STEM workforce. Now they have been joined by leading House Democrats and a bipartisan group of senators.

So, the general political climate seems favorable to what Immigration Voice is trying to achieve. The question is whether IV can cash in on the opportunity.

There is just one other way that you apply for citizenship , get it and then sponser them for GC again but that whole process would take a year at least and money too.

Best thing would be to wait . I am sure that EB3 India would move by a couple of months in this year and your family would get the GC's. If you have waited for the last 8 years for them , another few months should not matter.

Going the citizenship route is probably going to take longer in your case I think . You can try that if EB3 doesn't move in the next six months.
