Hello,
I am working on H1-b visa. My green card stage: Priority date July '06, EB3, India. I-140 approved, I-485 filed Sept'07. I dont intend to use EAD for employment now.
I have a need to get my future spouse on H-4 visa. With EB3 India priority dates retrogressed, filing dependent I-485 for spouse is years away. (Unless rules change!)
Question 1: IF I loose my H1-b status (job loss) and find a new job using my EAD, my spouse on H-4 goes out of status. So what all options do I have to keep her in a valid status?
Question 2: Proactively, say my spouse (when on valid H-4 status) starts a Masters program (part-time) at a University, can she file for a H4 to F-1 change of status (COS) that very week or month I loose my job. Or are there any serious timing issues in this option?
Thx

Illegals are another story, and now we need to focus on the legals, as all efforts trying to bind legal and illegal together turned out to be failure completely.
While we can keep an eye on these articles - these are coming up to counter our efforts.
Lets keep the focus on.
I would only say - IV is for legal immigrants, for those who have maintained legal status and have played by the rules.

Hi,
I need to renew my passport at the Indian Consulate in NY. I
have a couple of quick questions. It would be great if someone could
answer them for me.
(1) Do I need to leave my I-94 card in when I give them my
old passport? Is it OK if I remove it? Do they make a big deal of this?
(2) In the online form, what do I choose for the "Service Desired" field?
"Re-issue of passport"?
Best Regards,
Euclid

Hello,
My husband and I got married in December 2008 while I was a tourist in the United States. In order to stay and live with him, I sent an I-485 application with all the package (I-131, I-765, I-693...).
I have received 2 advanced paroles and my work authorization and will have a SSN in proably 2 weeks but the green card, if accepted, will come very late.
Now I really would like to visit my family and friends in Belgium for Christmas (or later, regarding to the job I will have) and I have heard that the advanced parole will not help me a whole lot.
So my questions are:
- Who should I contact to be sure that my husband and myself can go visit my family without any problem at the border, I mean, with the certitude I can come back in Pennsylvania with my husband? The customer service is not really helpfull this time.
- Can I do it at all without beginning everything from the beginning and restarting all the immigration procedure?
- What and to whom do I need to proove that I don't do anything bad and that I just want to visit my family and friends?
- What kind of documents do I need to take with me? What kind of forms do I have to send to USCIS or DHS?
I know it's not a question of life or death and there are a lot more urgent problems for other people, but I psychologically need to visit them and present my husband to some of my friends.
Could you please help me? Thank you.

Since her is the derivative GC and you are already approved there are no employment letters needed.
She needs to use AP/EAD to travel/work maintain legal status at all times.
You just need to be financially solvent just in case they ask for financial support docs I dont see that happening.
If your PD is EB3/2003 i dont think she will have to wait too long.
Too many people with PD 2001-2003 along with several 2004-2005 are approved or getting approval. anyone with Pd 2003 and above should not have to wait too long.

My lawyer received all the receipts for our AOS, EAS and AP applications and today I got COPIES in mail from her.
Wasn't she supposed to send me the originals and keep the copies? After all, it's my application.
I want to call her but I'm not sure what the general practice is. Did you guys get copies or the original receipts from your lawyers?
Thanks!

Send him a letter by certified mail and then dump the bloodsucker ! Noncompete agreements are very dubious in the first place so I doublt the employer would try to reclaim the loss.
Also you can get a free initial consultation from a licensed lawyer, there are plenty of options here. At most he would charge you something around $200

Hi Folks.
Whats the cost of filing a motion to reopen the case 485 if wrongly rejected(either due to using AC21...). I mean lawyer fees + other fees.
I am sure there are folks here who went through this.
$585 per MTR (ie principal, spouse, child all seperate) to USCIS. Lawyer fee depends on nature of MTR - usually AC21 MTRs are common and the LAWYER fee must be nominal ie in the $1000 per MTR range

Hello Everyone,
We are currently evaluating our options of starting a business on EAD, which should be coming within 3 months of filing of I485 in July. Does anyone know if I or my wife can start a business on EAD, are there any issues with it?
Thanks

What happens to the people who graduated from the institute and applied for gc on its basis?
It depends. If the University was never accredited by a recognized accreditation board, then USCIS would never have accepted that degree. If it was accredited before being shut down, then you might stand a chance. But if as someone has posted the university never had a .edu domain, then I doubt it was accredited by a recognized board at all.

Maybe if it were wolf tracks or bears or something dangerous.
... especially if the wolf or bear were standing at the end of the tracks, looking back over its shoulder (from a safe distance, of course!]. That would make an interesting shot.

Hi
I have been on H1 for 4 years in the US and left the country last november voluntarily due to personal reasons. My H1 is still valid till next year september. Now that I have over the "365" days rule... my employer propositioned me to come back and work for them. My question is :
If I apply for H1 after november would USCIS consider this as a fresh 6 year period starting next year?
Second - If I apply for H1 after november will I only have 2yrs since I have not completed the six year period. If so, what is the solution after coming back to make use of the six year period.
I hold an MS from US, so I would imagine that I fall under the Advanced degree Cap of 20,000.
Please post some feed back people.

I do not know if this has been posted on this forum..
But some of the testimonials are interesting for Students & STEM based EB applicants..
This is from Immigration-law:
02/14/2008: House Subcommittee Hearing on Status of Visas & Policies on Foreign Students and Scholars on February 7, 2008
The House had this important hearing that can have an impact on the employment-based immigration issues relating to the STEM foreign graduates in research and higher learning institutions. It is suggested that the EB immigrants in STEM to review the testimonies of witnesses in this hearing.
Purpose and Summary of the Subject
Testimonies of Witnesses:
:: Opening Statements by Rep. Brian Baird
:: Witness Statements ::
Mr. Tony Edson
Ms. Catheryn Cotten
Dr. Harvey Fineberg
Dr. Allan E. Goodman
Under the current political environment and a long pause in the employment-based immigration legislation issues in the Hill, this is indeed an important news in that at least the Congress is giving attention to the predicament the research and higher learning institutions are facing owing to the failure of the do-nothing Congress and the Administration to act on the matter.
