can you reword the title? I am not sure how that title is accurate given the background of how macaca was used: Sidharth (who was born and raised in the US, but is of of Indian origin) was called Macaca by George Allen because of the color of his skin. Getting a GC or not getting a GC does not change the color of one's skin so it does not stop people from calling you a macaca...
Admins can change the title - but I guess the title does not hurt - it wakes up people to what reality they live in and pretend they don't care

It is very possible that my question might have already been answered in the past but after searching through many forums, I could not find a direct answer.
Here�s my situation:
Category: EB2
PERM approved.
I 140 approved.
PD � Dec 2007.
H1-B status: 6 yrs expiring Sep 10. Filed for 3 yr extension.
I have an excellent chance of a promotion to a managerial level position. I am seriously considering abandoning my current GC process, accept the managerial position and reapplying for a new H1-B and GC.
Questions:
1. Will I need a new H1-B? If so, for how many years will I get it?
2. When I apply for a new PERM, will PD of Dec 2007 still be valid?

1. You will need a new H1-B with a new LCA appropriate duties and responsibilities, wages etc.
2. Yes. You can retain the old PD with the I-140. Take care to note that that you are not applying for the PERM but your company will be and your company may or may not find qualified citizens/permanent residents. You do not and should not control the recruitment process.

1..I would like to know if an employer revokes 140, and if the AC21 is not submitted at the time of NOID...how many days are given by USCIS?
Is it 30 days?
2..If I go to another emplyer and try to do interfile, still I need to file AC21?
And if the new category is EB2(my old application is EB3), still is that ok?
For eg..EB3 title is system analyst, and if I want to go for Eb2 then which could be more apprepriate..?Senior SYSTEM ANALYST

Yes, you can change your employer's from India but you need to go for stamping again at US Consulate and get a new VISA to enter into US.
I went through same situation in 2008 and i'm in US now.

harry the reason u may not be getting much of a response to your thread might be because the AC21 portability issues have been discussed in detail several hundred times on this forum.
Just look for the AC21 Portability forums/threads and read thru them and it'll help your understanding.

I arrived through IAD (Washington Dulles Airport) on 12th morning.
I am on AOS 485 pending, EB3-I.
But entered on H1.
ZERO questions asked or any issues encountered at IAD.
There was only 1 officer assigned to take care of non-US citizens.

I�m in EB2 and My I-140 was approved September 2008 through Employer A. And I got laid off on November 2009 from EMP A, within 15 days I joined another Employer B. As per policy, employer B is not going to file GC for me. Already I spend 5 years on my H1B. I check with EMP A�s HR dept, they will not revoke my I-140 and H1B. I know AC21 is one of the options to transfer (Portability) my PD to Emp B after apply I-485.
It would be great if I get answer the below my Question:
1. If my PD is current, Will I eligible to apply I-485 using Employer A I-140 approved?
2. What are the documents needed from employer A, if I want apply I-485?
3. All my friends telling me, I can apply I-485, Is it true?

No you cannot apply I485 in company B. when your PD is current if you go back to your Company A , then company A can file I485.

Are you working now? Consult any immigration lawer on the steps to follow on the H1 transfer. I am not sure if there is a clause that you should have worked on the current company few months and get the pay checks. Also to transfer H1, you need copy of your 797 and not original. You can get it from your employer or from the lawer who filed H1. Bottom line, the forum answers should be taken as only guidence and not advice. Consult a IM lawer to confirm anything before you act.

Hi,
I work for Company A. My labor and I-140 has been approved with Company A. I am in my 9th year H1 extn.
I plan to join Company B using H1 transfer (AC21) and they also help me continue my I-485 by proving similarity of job.
There is a high likelihood that Company A will revoke my I-140 once I tell them I am leaving to join company B. I am safe with B because H1 transfer and I-485 has been done prior to I-140 revocation.
However, if I were to join a third Company C using H1 transfer (AC21). Can I do it and also keep my I-485 pending? Please advise.

Can any of you throw some light on these
To my understanding, if one is maxing out 6 years of H-1B visa on Nov 30, 2009 and doesn't have a way of extending to the 7th year H-1B.Then he has to stay physically outside of USA for 1 year.
1.Does 1 year stay have to be in the home country only?
2.Can one come and visit USA for a month[June 2010] or so between Nov30,09 and Nov 30,2010.[Eg: Conference, interview]?
3.If answer is yes to 2, would one have to stay for another 1 year away from July 2010? or they can come back to US during Dec 2010, if they have a new H-1B job?
Inputs appreciated.

I guess what I was trying to illustrate was that I'll be spending less time in PS trying to bring out detail in the eyes which exactly what I did in my original post edit of the first photo. With the set up I have going now you can see the whites of the eyes better along with the color of the eye to the pupil. So less time in PS = more time shooting. ;)
