President Obama says he wants to change United States immigration policy. But so far, immigration has taken a backseat to other pressing issues, like health care, the economic recession and the ongoing conflicts in Afghanistan and Iraq. But Rep. Luis Gutierrez, a Democrat from Illinois, wants to bump immigration to the top of the President's agenda. Gutierrez explains why he thinks comprehensive immigration reform cannot wait any longer.
Gutierrez is panicking on something that we already know: CIR is dying. As CIR gets delayed, its chances diminishes with the approaching election year (2010).
Gutierrez is from a high-immigrant area of Chicago (Cook County) but it will cost massively for Democratic party in the purple states. Democratic party will never
risk its fortunes over the tantrums of Gutierrez.

Is university h1 the same as non-proft cap exempt h1 or is it different ?
Its the same as a university comes under "Higher Education".

You can work 2 jobs as long as you have...2 H1 visas, one for each job!!
That could be 2 part-time or 1 full time and 1 part-time.
I believe there could be a problem if you have 2 full-time H1 jobs at the same time...

You have to withdraw old LC while filing the PERM hence prepartion can be parallel. It is better for you to file PERM ( you get it in 50 days or earlier) & get 140 ( 2 months after LC) & therefater apply for 3 years H! B extn.
You will not have to go through H1B circus, if you & others support IV & atleast generate $$ which is really driving our effort other than core members.

Depending on where your would be spouse is ,there are two methods.
1. If she is outside the country , you would have to get her H-4 at the nearest consulate.
2. If she is in the country , and assuming you want to change her status to H4 , you can do it by filing the change of status form with USCIS.
Either way I do not think you would be requiring a lawyer. It is pretty straight forward. All the required instructions are on the form.

No you don't have to wait for your 3 year extension to return to US. Your lawyers and company are basically trying to get your three year extension so that you can get a 3 year visa stamped in your passport. But there's nothing stopping you from returning to US at any time on your current H1b.
For your second question - no you don't have to be present in the US to file for the extension .

If your MIL is not in the US, you cannot technically extend the visa.
