If you have a pending I-485 for her, she will be in parolee status once she enters on AP.

I also have same question. DO we need to send COS. I heard that after getting receipt one is authorized to stay in US. I might be wrong. Please reply if anyone thinks differently..

I HAVE H1 APPROVED TILL 04/10 BUT I ENTERED USA USING AP THIS YEAR SO MY UNDERSTANDING IS THAT I AM ON EAD NOW WITH SPONSORING EMPLOYER. I AM ASLO DOING PARTIME JOB IN OTHER FIELD ON EAD SINCE 01/08. NOW IF I GET FULL TIME JOB WITH OTHER EMPLOYER (other field)AND IF I WORK LESS HOURS (means I get under pay than showed in labor) WITH SPONSORING EMPLOYER, WILL I BE IN TROUBLE? I had a visa from Company A till Oct1 2008 and I 94 till that date.I changed to Company B and was given a new I 94 till June 2009.I made a trip to Canada and got a different I 94 again till Oct 1st 2008 based on the old stamped visa.I didnot get my passport restamped during the trip.
Questions
Which I 94 is valid?
Am I overstaying If I stay after Oct 1st?
I have an appointment in Halifax on 16th Oct,Will the Halifax consulate revalidate it?(I have changed companies here)

:mad:I have another query and thats is i have a a far related cousin and her husband is on l1 visa . now my query is what visa is she on and what visa is her daughter on who was born here few months bak . also how shud she apply for a passport for this kid . is this kid an american citizen and also how to go about passport for the kid and also is it required to apply for visa for the kid to travel to India . Another serious issue she is been illtreated by her husband and how should she report this matter to the local police here .

* Ask her to call her local police station (or even 911) and report this to the police (unless he has been physically abusive, she can probably tell him the next time he misbehaves she'll go to the police. Explain that a police record could mean lots of problems for him, going all teh way from GC, to getting a future job etc. If he does not shape up or has been physically abusive, then have her contact the police.)

Hi guys,
My I140 was approved last week (RD July 2007). I have the approval notice copy from the lawyer but the online status is still saying its pending.
I called uscis and she told me that she is seeing that its pending too but if i have the approval notice then not to worry. It takes them some time sometimes to update the system, as per her.
But my concern is, when my PD becomes current and if their own system shows my I140 penidng(eventhough it's approved), how will they approve 485?
Any one in same boat or any past experience?

now-a-days, Online system is not in sync with the case system. Level CSR will see what you see on online system. As long as you have the hardcopy of the approval, you are good to go. Someday, online status will change.

On my first return the immigration officer kept my AP document at POE (NY) but the 2nd time it was stamped & returned (Washington DC was POE) to me. I was wondering if I could use this document for subsequent re-entries or do I have to apply for a new AP.

My confusion is, as soon as I enter on AP I am on EAD and I don't have approved EAD. Does this mean I can not work untill I get EAD approved? I don't have Visa Stamped and I am not planning for Visa Stamping.
you can still continue on H1B (same employer) as long it is validity..even when you use AP at POE..

Agree on the eye, it's important to see that, and have a little catchlight for making the animal look alive. Only problem with the first shot is the branch behind the head. I am working with a client in Los Angeles, CA.
My H1b Visa expired in 05/2010 and I just got my 3-year extention.
In my petition I gave details of current client.
Today an Agent came from USCIS for an onsite(client-side) visit and verification.
The agent asked me various question mostly related to my petition
I was told my name was picked up randomly.
It is part of USCIS Site visit and verification Program
Anyone has a similar experience?

Q1) I would like to take a US consulate appointment for visitor's visa for my father. We are from southern Andhra Pradesh and Chennai consulate is convenient for us. Since Hyderabad has US consulate, does whole of Andhra come under HYD consulate jurisdiction? or can we take appointment in Chennai Consulate? Could you please let me know? My father is going for visa for the first time.
Q2) If visitor passport is expiring in next eight months and if the visitor is residing in US, is it possible to renew the passport here? Or the person has to go back to India and renew the passport there. I would just like to help my parents with the paper work and get it done if possible when they are here.
Your help is appreciated.
