I applied under EB2-NIW on July 28, 2007. Under the concurrent filing allowed at that time, I submitted NIW, I-140, I485, and EAD applications for me and my wife. I have changed jobs, and joined a new company last week.
Since I filed a self-petition, my application should not be directly affected by this move. However what do I need to do to inform uscis about this change, so that my receipts/EAD etc. do not go to the wrong place, or worse, get returned by the post office.
Please advice. Any additional info/experience would be great.

If I were you, I would just do a little search in the forum and close this thread. There was an extensive discussion on this very topic for days and the thread had to be eventually closed because it was taking ugly turns. Let's not go that route again. "I would like to hear your professional opinion on the following issue: I have been on F-1 visa for 7 consecutive years. I have an employer that has sponsored me as a Graphic Designer. In fact I have obtained the I-140 through him already. I recently applied for employment AOS (July 25th) with my wife (She is on F2 visa) and I'm currently waiting on the Notice Receipt. School starts on August 20th and I'm hesitant on when exactly the new Immigrant Status starts. Do I still need to enroll for classes in order to maintain my visa? I don't intend to finish school due to financial difficulties, when exactly may I drop out from school? Should I remain enrolled up until I receive the EAD and AP? Thanks in advance for your response."

If my H1 transfer is approved on say 1st August 2010, do I need to join the new company immediatly say 2nd or 3rd or can i take some more time say 2-3 weeks (Aug 20th) to join?

Hello friends - the recd. date on my 765 application is August 7th...it's almost 90 days now (11/5 - next monday) that my application will be pending.!
Same is the case with AP..! No news at all for EAD & AP..Worried now!
Can i make a appt. with INFOPASS for both my EAD & AP together...? And what is the A # that they ask for when we fill Infopass appt.? Is it A # on 48 receipt notice.? OR A # on 140 approval notice.!

There is no need to withdraw your 485. But why do you need 2 485's. It just shuts out visas for others. You can continue on H1b with your current employer and join in EAD with the other.

Under current USCIS processing two 485s do not waste visa numbers (as visa numbers are only assigned at the time of approval). When petition is approved, the other one will be automatically denied/withdrawn, or USCIS will send an RFE just around approval time, asking for one of the two apps to be withdrawn.

Hello,
I am on H1, have filed Labor on 10/30/2009 (awaiting decision) and still have 2 months to go before my 6th year of H1 starts.
Now, i have plans for higher studies, but since i am a consultant/contractor and my projects are all over the US, I am planning to go full time (early 2011) either in US or outside.
I checked with a friend if I should go full time in US and he told me that since i have filed Labor, i have shown 'immigration-intent' and therefore my F1/student visa request will be denied, since F1/student visa is a non-immigrant visa.
Now my question to this forum of lawyers is, Is the above true for F1? Also, if it is true and due to that, if i plan to study outside USA and after my studies (which keep me out of US for more than an year) want to come back and work in USA, will my request for an H1 also be denied due to the same 'immigration-intent' i showed in my Labor process earlier, since H1 is again a non-immigrant visa?

This bill was passed as part of the Labor-HHS 2008 appropriation bill. Reportedly, this bill faces two roadblocks ahead to make it into a final legislation. One is the White House that has been threatening to veto the Labor-HHS bill in toto because of the amount of spending. Second is the House that has to agree to the Senate version in the conference committee. However, the second roadblock does not seem to pose any serious threat as demonstrated by the move of some of Democrats in the House. Please stay tuned.

Hi All...
My attorney filed my EAD (mailed) on August 28 this year and last Friday I saw the approval too on USCIS site. Today I decided to help one of my friends with his EAD so I decided to pull the attorney filed copy of my I-765, I noticed that attorney had mentioned "AOS" in Q:15 instead of H1B. I am on H1B and I have never used my EAD... so I am worried now and I don't know what are my options now... Would you please take few minutes of your precious time and help me with the options I may have now to correct this issue?

In our 485 notices, Under the section, it is stated as Unknown. priority date is blank. Please let me know if anyone is facing similar situation and what needs to be done to correct it?

Same boat. My brother's marriage is in the last week of August and I have to travel to India.
When I go to India, I will need to get H1b stamping on extension - will that be an issue?
If I apply for 485 now, and they send biometrics notices when I am in India (will be there for a week in last week of August) , will it be an issue? Though it is a long shot?
Changing address - I will be moving into a new apartment soon (in 3 months) - so effectively after applying 485, I will be moving to a new apartment - how will I handle address change?
Can anyone help me with these answers :)
